This agreement describes the entire terms and conditions for participation in Marketing Portal Associates Program. In this agreement, the term "Participant" refers to you (the applicant), and "sponsoring website" refers to the website from which you will link to Marketing Portal. Wherever the agreement refers to "you" or "your", it means "the Participant"; "we" or "our" refer to Marketing Portal, and the terms "product" or "products" refer to the e-Book (Sales Techniques & Selling Skills Revealed).

You can add or remove links at any time: The Participant may add as many links to Marketing Portal, or remove such links, anytime and without prior approval from Marketing Portal.

Referral Fee Qualifying Condition: Participant will earn referral fee(s) from sales of our product if, and only if, he/she fulfils the “qualifying condition”.

§         Criteria that must be fulfilled to constitute fulfillment of the qualifying condition:

1.       Product(s) is (are) sold to customer(s) who follow(s) a dedicated link from your sponsoring website to our site and submit(s) that order(s) by using the Marketing Portal order forms, contact phone number or mailing address.

§         Note: Take note that product(s) or course(s) sold through any links other than that assigned to you will not constitute fulfillment of the referral fee qualifying condition.

Referral Fee Amount: The purchase price of the qualified product(s) will be totaled toward the total sales figure for the calendar month in which such product(s) is (are) sold. Only qualified product(s) that is (are) sold through Marketing Portal, shipped/sent to a customer, and for which Marketing Portal has received full payment, will qualify for a referral fee.

The total of such sales in any given month will generate referral fees, based on the flat rate referral fee method, as described below:

Five Tiers Affiliate Program: 

First Level (Direct Earning) = 30%

Second Level (Indirect Earning the sale created by Sub-affiliate) =10%

Third level (Indirect Earning the sale created by Sub-affiliate) = 5%

Fourth level (Indirect Earning the sale created by Sub-affiliate) = 3%

Fifth level (Indirect Earning the sale created by Sub-affiliate) = 2 %

Referral Fee Payment: Marketing Portal will send a cheque quarterly when reach US$200 or and above to the Participant approximately 15 days after the 1st day of each calendar month. The payment is conditional on the fulfillment of the terms and conditions listed in this agreement. Or Option to Use their email as Money Bookers account to credit the commission when reach US$50.00 on the day between 15 -17 of the Month by Monthly Payment of Commission.

A Statement of Customer Purchase Activity will be sent to the Participant at the end of every quarter in March, June, September and December.

Referral Fees:

Returns and Cancellations: If (a) customer(s) should return or cancel his/her order(s) of the product, the appropriate deduction will be made in the subsequent monthly payment to be sent to the Participant, if the referral fee had been paid earlier. In the event that the Participant has not earned any referral fee for the month, or that the fee earned is insufficient to offset the deduction, the Participant will be billed for the difference. 

Order Processing: Marketing Portal will be solely responsible for processing every order placed by all customers who follows the dedicated link from your sponsoring website. Orders will be made using Marketing Portal’s secure online ordering process, Marketing Portal phone line, or Marketing Portal mailing address. Order forms, payment processing, shipping, cancellations, returns, and all relevant customer service are the sole responsibility of Marketing Portal.

All rules, operating procedures and policies of Marketing Portal regarding customer orders and accounts will apply to orders we receive through the dedicated link(s) at your sponsoring website. Marketing Portal reserves the right to reject any order that does not comply with our rules, operating procedures and policies.

Tracking of Sales: Marketing Portal will be solely responsible for tracking sales made from customers who follow the dedicated links at the sponsoring websites. The Participant will be solely responsible for ensuring that these links are properly formatted, which is a necessary prerequisite to track sales records. Statements of Sales Activity will be provided (in real-time) for the Participant at the URL that he/she is assigned.

Promotional Techniques: The Participant is free to promote the link to Marketing Portal i  l n any of the methods we recommend in the introduction email letter that you will receive by email after signing up with us. Examples of recommended ways to promote the product include: through banners, text links, letters of recommendation to newsletters subscribers or your client base. However, if the Participant adopts the SPAMMING method (in any way, shape or form), or offers the course on any WAREZ, CRACK, or SPAM-oriented site(s), this Agreement provides Marketing Portal with the right to terminate his/her account without any notice given! Any referral fees that have not been paid up to the point of termination will cease to be payable.

If the Participant opts to promote the product under the Marketing Portal Sub-Reseller Program, it can only be promoted as a Five-tier business opportunity. This program is a 5 tier multi-level marketing Online  opportunity, and as an affiliate, you promote it as a 5 tiers network online business. This Agreement provides Marketing Portal with the right to terminate accounts without any notice given if the Participant promotes the Marketing Portal 5 tiers Affiliate Program by spam or spam by invalid email! Any referral fees that have not been paid up to the point of termination will cease to be payable.  We reserve all the right,  Not allow to appeal for the affiliate account with Marketing Portal by having the proof for those who using invalid email spam for recruitment of sub-affiliate. 

References/Testimonials: With the Agreement, the Participant undertakes to cooperate with Marketing Portal in the development of joint press releases and testimonials. He/She will further agree to allow Marketing Portal to use his/her company name in marketing collaterals, and to make reference to you on our website.

Associates Signing-Up Under Themselves: We will not tolerate current associates who sign up as sub-associates under their own assigned referral number in order to generate the additional commissions for their own sales. Marketing Portal has extensive tracking software in place to guard against this unethical practice. Any account(s) who is (are) found to be guilty of this practice will be terminated without notice, and any referral fees that have not been paid up to the point of termination will cease to be payable. The company also reserves the right to bill the Participant for the amounts that have been erroneously paid earlier. To put it bluntly, it's not worth trying!

Copyrighted material: The Participant is solely responsible for ensuring that reviews; course descriptions and articles (whichever is relevant) comply with all applicable copyright and laws. You must have expressed permission to use another party's copyrighted material. Marketing Portal will not be held responsible if you use another party's copyrighted material in violation of the law.

Marketing Portal policy applies to all orders: Every customer who buys a product through this program is deemed to be a customer of Marketing Portal. The Participant does not have the authority to make or accept any offer on behalf of Marketing Portal. All Marketing Portal policies regarding customer orders, including product availability, pricing and problem resolution, will apply to these customers. Marketing Portal is not responsible for any representations made by the Participant, which contradict our policies.

Product prices and availability: Marketing Portal will determine the price to be charged for product(s) sold under this program in accordance to our own pricing policies. We reserve the right to change the price as the company deems fit. In case of any price discrepancies, the price charged to the customer will always be the price listed on Marketing Portal web page: www.selling-techniques.com , www.ambitiondesire.com, www.salesroles.com  linked from your sponsoring website.

Product availability can change, and Marketing Portal undertakes to present the best information available to all sponsoring sites and its clients.

Website service interruption: Marketing Portal will make all effort to keep its website operational. However, technical difficulties may, from time to time, result in temporary service interruptions. The Participant agrees not to hold Marketing Portal liable for consequences of such interruptions.

Trademarks, Trade Names, & Patents: You hereby recognize our right of ownership of all trademarks, trade names, and patents associated with our services. You will act consistent with these rights, and act to preserve them in the course of marketing and sale of these services. We grant you the access to our trademarks and trade names in connection with marketing and sale of these services.

Term of the Agreement: The Participant will receive referral fee payments for qualified orders that are placed during the term of this agreement. This term will begin on the date that your application is approved by Marketing Portal, and shall end when canceled by either party.

Referral Fees earned through the date of expiration or cancellation of this agreement will remain payable only if the products are not returned or canceled from their orders. Notwithstanding any other clauses provided in the Agreement, payment of the final referral fee payment to the Participant may be withheld for a reasonable time period in order to ensure that the correct amount is paid.

The agreement may be modified: Marketing Portal reserves the right to change any of the terms and conditions in this agreement and the price to be charged for the product, at any time and at its sole discretion, by posting a new agreement on our website.

Annulment of this agreement: Either Marketing Portal or the Participant, acting in their sole discretion, may choose to annul this agreement at any time by written notice of cancellation to the other party.

Disclaimer:

Marketing Portal makes no warranty or representation with regard to the program or, except as expressly set forth in Marketing Portal's then current product sales policies, any products sold thereunder, whether express or implied, arising by law or otherwise, including without limitation any implied warranty of merchantability or fitness for a particular purpose or non-infringement or any implied warranty arising out of course of performance, course of dealing or usage of trade.

Limitation of Damages: Marketing Portal will bear no liability for any indirect, incidental, special or consequential damages or any loss of revenue or profits arising under or with respect to this agreement or the program, even if Marketing Portal has been advised of the possibility of such damages. Further, Marketing Portal's aggregate liability arising under or with respect to this agreement or the program shall in no event exceed the total referral fees paid or payable by Marketing Portal to the Participant under this agreement.

Miscellaneous: The Participant and Marketing Portal are independent contractors, and nothing in this agreement is intended to, or will create any form of partnership, joint venture, agency, franchise, and sales representative or employment relationship between the two parties. The Participant shall not assign this Agreement, by operation of law or otherwise, without the prior written consent of Marketing Portal. Subject to the foregoing restriction, this agreement is binding upon, insures to the benefit of, is enforceable by the parties and their respective successors, and assigns.

Governing Law: the laws of the United States, Canada and Singapore shall govern this agreement without reference to its choice of law principles.ink directory h
